EU-US trade agreement: amendment to the US customs tariff

With Executive Order 14346, signed on 5 September 2025, the US government has initiated measures to adjust tariffs and trade procedures between the United States and the European Union. The aim is to implement the framework agreement announced in August. 

Adjustment of the Harmonised Tariff Schedule 

The US Department of Commerce has published the changes to the Harmonised Tariff Schedule of the United States (HTSUS) in the Federal Register. These came into force on 25 September 2025 and particularly affect imports from EU member states.  

Changes for motor vehicles and vehicle parts 

Differentiated customs duties will apply to vehicles and car parts from the EU in future. Products with a previous ad valorem duty rate of at least 15 per cent remain exempt from additional duties. Products with a lower rate are subject to a combined duty rate of 15 per cent. These regulations apply to goods imported into the US from 1 August 2025. Importers can submit correction requests to apply for refunds or adjustments. 

Continuation of existing exemptions 

Tariffs on aluminium, steel, copper and other products already covered by Section 232 remain exempt from counter-tariffs.  

Adjustments for aircraft and selected products 

Civil aviation products from EU countries have been exempt from additional tariffs since 1 September 2025. The same applies to certain unavailable natural resources, essential oils for religious purposes, and non-patented pharmaceutical products and precursors. 

General duty rate 

For all other products originating in EU countries, a general duty rate according to column 1 of the HTSUS continues to apply.
