The templates for end-use declarations for direct and indirect exports to Russia have been updated. The updated templates are available on the website of the Federal Office for Economic Affairs and Export Control (BAFA) (section: ‘Forms’).
The revision applies to Annexes C 6 and C 7. Annex C 6 concerns exports of goods to Russia or for use in Russia that are listed in the annexes to Regulation (EU) No 833/2014. Annex C 7 applies to exports of listed dual-use goods to Russia or for use in Russia.
New queries in Section G
New queries have been added to Section G concerning companies based in certain special economic, innovation or preferential zones. Companies owned or controlled by a company based in such a zone are also covered.
No new declarations required for current applications
The BAFA points out that, as a rule, no new end-use declarations need to be submitted for applications that have already been submitted and are still being processed. If you have already requested end-use declarations from your customers in accordance with the previous templates, you do not need to ask them for a new declaration.
Recommendation to avoid queries
However, in order to avoid queries, the BAFA recommends that the additional information from the new templates C 6 and C 7 (Section G) be submitted with the application if possible, for example in a separate letter.
Templates for guidance
In addition, the templates are only intended as a guide. You can also use your own forms, as long as they contain all the necessary information and the application can be processed with them.
