Third package of measures for more efficient export controls in force

On March 1, 2024, the Federal Ministry of Economics and Climate Protection and the Federal Office of Economics and Export Control announced further measures to accelerate export controls. These measures came into force on April 1, 2024. They include amended and new general licenses, about which the authorities are now providing detailed information.

A new general license was announced as part of the third package of measures. General License No. 36 applies to the export and transfer of naval equipment to certain government end-users, e.g. the navies and coast guards of the member states of the European Union and certain NATO member states.

General License No. 36 favours the export and transfer of goods under numbers or sub-numbers 0009, with the exception of surface vessels and submarines, 0011a, 0016, 0017 of Part I Section A of the Export List (Annex AL to the AWV). Excluded are goods that are named in the War Weapons List (Annex to the KrWaffKontrG).

Exports and transfers carried out on the basis of AGG No. 36 must be reported by the exporter or transferor to the BAFA every six months via the ELAN-K2 export system.

General License No. 36 entered into force on April 1, 2024 and is valid until March 31, 2025. With the exception of General License No. 15 (Brexit), all BAFA General Licenses are valid until March 31, 2025.


Amendments to the AGG in the area of military equipment and dual-use goods

In the area of military equipment, the content of existing general licenses has been amended and in some cases extended. In the area of dual-use goods, changes were made to the content of General License No. 39.

In the area of other general licenses, general licenses no. 30 and no. 31 were newly announced with effect from 1 April 2024. These general licenses are also valid until March 31, 2025.
