BAFA announces changes to AGG reporting obligations

The Federal Office of Economics and Export Control (BAFA) has implemented changes to the reporting obligations for certain General Licences (AGG). The changes came into force on 11 December 2023. According to BAFA, there are no further changes to the content of the general licences. The previous period of validity of the affected general licences will also remain in place until 31 March 2024.

With these measures, BAFA aims to further strengthen and accelerate administrative processes in the area of export controls. The aim is also to reduce the burden on industry. Further simplifications are expected at the turn of the year 2023/2024.

Amendments relating to AGG Nos. 19, 21, 22, 26, 27 and 28

The period for submitting the semi-annual reports on exports/transfers that have been made using the corresponding general licences will be extended. The semi-annual declarations on the use of General Licences No. 19, 21, 22, 26, 27 and 28 can therefore be submitted for the second half of the year from 1 January to 31 January and for the first half of the year from 1 July to 31 July.

Changes concerning the AGG No. 33

The reporting period for General Licence No. 33 will be extended from the current two calendar weeks to one month. For exports made on the basis of General Licence No. 33 from 1 January 2024, the notifications must therefore be submitted in the following month at the latest. In the case of General Authorisation No. 33, notifications can be submitted daily and therefore continuously. In addition, the deadline for submitting the first notification for exports and shipments that took place before 1 January 2024 on the basis of General Licence No. 33 will be extended and postponed to 31 January 2024.

In addition, information on the end user will be added to the information required when submitting the notifications. This concerns the name, address and type of end user. Three options can be selected for the type of end user in the BAFA reporting portal: Armed forces, police and security authorities as well as companies and other end users.
