BAFA refers on its website to the public consultation of the EU Commission on the "Guidelines on the export of cyber-surveillance items under Article 5 of Regulation (EU) No. 2021/821".
European stakeholders have until June 9, 2023 to comment on the draft as part of the public consultation. All stakeholders with an interest in the export of dual-use goods and technologies are addressed. These include, for example, exporters, industry associations, government agencies, universities, research institutions and non-governmental organizations.
Consultation Background:
The EU Dual-Use Regulation (EU) 2021/821 tightens export controls on digital surveillance items not listed in Annex I that may be used, in whole or in part, for internal repression and/or the commission of serious violations of human rights and international humanitarian law.
The Regulation mandates the European Commission to provide guidance to exporters on Article 5 in accordance with Article 26.
