The Bureau of Industry and Security (BIS) has introduced new export controls in the area of critical and emerging technologies. The controls apply to semiconductors, quantum computers and additive manufacturing products.
The following changes have been made by BIS:
• Introduction of new Export Control Classification Numbers (ECCNs) for quantum computing, semiconductor manufacturing and other advanced technologies
• Revision of existing ECCNs
• Introduction of a new licence exception called "Implemented Export Controls (IEC)", which allows exports and re-exports to countries that have introduced comparable technical controls
Affected technologies are quantum computers, related equipment, components, materials, software and technology, as well as tools and machinery for the production of advanced semiconductor devices and technology for the production of high-performance computing chips. Also affected are equipment, components and related technology and software for the production of components made of metal or metal alloys.
Overall, this development offers both challenges and opportunities for European companies. On the one hand, the introduction of the new licence exception (IEC)facilitates trade with countries that have introduced similar controls. This can improve market access for European companies and reduce barriers to trade. On the other hand, European companies must ensure that they fulfil the international requirements. This may require adjustments to their supply chains and export processes in order to minimise legal and regulatory risks.
