On 5 September 2024, the European Commission adopted a Delegated Regulation updating Annex I to Regulation (EU) No 2021/821 (EU Dual-Use Regulation). This regulation is expected to enter into force at the end of 2024/beginning of 2025.
The updated Annex I will include new and revised controls for dual-use items that take into account the latest technological developments and international security concerns.
In Annex I of the EU Dual-Use Regulation, the terms cargo reinforcement and high performance diesel engines, which were derived from the Technical Notes of items 6A002a2, 6A002a3 and 9E003g of Annex I, have now been included in the definitions section. However, the term insulation has been deleted, taking into account the added notes in 9A108a and 9C108.
In addition to parameter changes and text amendments, new sub-items for exchange facilities (0B004a3 - a5) and for the exchange of hydrogen isotopes (0B004b10) were created in Category 0 of Annex I to the EU Dual-Use Regulation. However, 0B004b6 relating to infrared absorption analysers has been deleted.
In Category 1 of Annex I of the EU Dual-Use Regulation, new sub-items for iodine pentafluoride, dipropylamine and neosaxitoxin (1C011e, 1C350.90, 1C351d24) were added in addition to newly added technical notes and other text amendments. In category 3, the sub-items 3A002e2 and 3A001c3 were deleted in addition to other changes. In categories 5, 6, 7 and 8, there were also editorial changes and text amendments.
In particular, the new (technical) note for 6C005.b, 6C005.b, 7A003.b, 7A105.b and 7A105.b should be emphasised.
Category 9 also contains numerous text amendments, which mainly concern the (technical) notes there.
