BAFA notifications subject to a fee since 1 January 2024

Until now, the services of the Federal Office of Economics and Export Control (BAFA) were free of charge - this has changed at the turn of the year. The new fee obligation of the BAFA and the Federal Ministry of Economics and Climate Protection (BMWK) stipulates that certain export licences will be subject to a fee from 1 January 2024.

The new obligation to pay fees essentially relates to services under the Foreign Trade and Payments Regulation, the EU Dual-Use Regulation and the Anti-Torture Regulation. Fees are now payable for the issuing of individual and collective licences, the extension of individual and collective licences and the amendment of collective licences.

There is no obligation to pay fees for decisions under the Embargo Regulations, for decisions under the Firearms Ordinance, for the provision of information as part of a consignee enquiry, a goods list enquiry or any other enquiry and for the use of general licences.

The "Special Fees Ordinance" also provides for a number of exceptions and exemptions. For example, there are no fees for chargeable services in connection with legal transactions and acts whose value does not exceed 5,000 euros. "Zero notices" are also still free of charge. In addition, a reduction of 25% for temporary export/transfer and reductions for collective licences are also provided for.

The new general licences came into force on 8 January 2024 and are valid until 31 March 2025.
