New General Licences No. 35, No. 40, No. 41

In our AWB News of 4 January 2024, we informed you about further measures taken by BAFA to speed up export controls. In particular, this involved adapted and extended general licences (AGG).

In addition to the notification of the updated General Licences, BAFA published further information on 5 January 2024.

The new general licence for the supply of spare parts up to a value of 25% of the main item to certain countries is AGG No. 35. One of the prerequisites for use is that the original export or transfer of the main item for which the spare parts are intended has been approved by BAFA.

General Licence No. 35 may be used up to five years after the date of issue of the licence for the export of the main item or - if a General Licence has been used - within five years after the export of the main item, provided that the licence for the export of the main item has not been revoked or withdrawn.

In the area of dual-use goods, two new AGGs were announced, namely AGG No. 40 and AGG No. 41. AGG No. 40 concerns the supply of certain chemicals to India. AGG No. 41 applies to the supply of spare parts up to a value of 25% of the principal item to all countries with the exception of arms embargo countries. One of the prerequisites for use is that the original export of the main item for which the spare parts are intended was approved by BAFA or by way of a general authorisation from the European Union.

The new general licences came into force on 8 January 2024 and are valid until 31 March 2025.
